CRAZY CRATE YOGS 82:  January 4, 2011.

 

We hope you had a pleasant Holiday Season this year.  We also hope you made a New Year's Resolution to keep working on your genealogy in the New Year and make some progress on some of those brick walls.  If you don't have one, good for you!  You can be pretty sure that some are looming in your researching future. 

Best of luck to all of you!  We are happy to help you in any way we can!  As you know from prior years, winter is when we try to update our website and add indexes to some of the books that have not previously had them posted on the website.  You will get to see them first in the Crazy Crates coming your way in January, February and March.

 

An apology is due to those of you who ordered the Indiana Territorial Pioneer Records from a previous crate.  Response was so good [THANK YOU VERY MUCH!] THAT WE RAN OUT OF FIRST ONE VOLUME AND THEN ANOTHER!  Progress Report:  Volume One is done, Volume Two is at the Printer's now, and he just brought Volume Three yesterday.  I intend to ship all three to you, just as soon as I get them.  Thank you for your understanding.  You have not been charged for them yet, nor will you be until they are shipped.

                            

Indiana Wills Project -[Total Book is available for $20 should you want them all together.]

Phase 1 begins with the creation of the county and covers wills left in every county courthouse [the 85 of them, which still had them in 1986.]  The other seven of them either never had them, or they were no longer available.

1.)  Benton CountyWill Records begin in 1857;

2.)  Boone County Fire on 12 October, 1856, destroyed the early Will  Records;

3.)  DeKalbCountyWill Records begin in 1852;

4.)  JasperCounty Fire in 1864 destroyed earlyWill Records;   

5.)  Madison County Fire 10 December, 1880,destroyed Will Records;

6.)  Newton County formed in February of 1858;

6.)  Noble County Fire in 1859.

 

Some of them have lost records to fire, flood, tornado, or other natural disasters and human carelessness; and these occasions are noted in the book.  Also five other counties have special 

circumstances, which account for not having a complete series of wills because of some, but not complete, destruction of Will Records: Clark, Clay, Dearborn, Sullivan and Vigo Counties Will Records 

are not complete or are not available to researchers.

 

This abstract covers all surnames except for those surnames having only one person listed.  The entire book has 72 people listed on each of 87 pages plus 61 names on page 88, because the last page is not quite full. For all surnames from A-L the listings have been provided to you in previous CRAZY CRATES.

 

The book gives you the complete name, the year of the probate of the will, the book designation, letter or number, and the page number in the book plus the county wherein the document was filed and is now located.  You have everything you need to write to the courthouse in that county and request photocopies[of the original will, if possible.]   

Now a successful genealogist would want to see a copy of the original will if that can be arranged.  Original wills may be in the testator's own handwriting, or, at least signed by the testator, after a relative or friend has written it out at the request of the testator.  If the original will is available, a photocopy can usually be obtained.

If the original is not available, a photocopy of the page(s) of the book [copied in the clerk's original hand-copying style] of that document will have to do. 

Many of the books were not available when the county was first formed, but the original wills were copied by the clerks later into the will books in the late 1870s and 1880s.  In many cases, you can have either or both.  Both is preferable!

Most of us have had the experience of reading the original and then the pages in the Will Book, only to realize getting a photocopy of some clerk's "copying" only made us positive said clerk's "copy" was not totally correct.  Children can be added or left out. Numbers may not agree  Details may have been copied incorrectly.

Also, many people may not realize that the books may have been lost or destroyed, and the originals which had been preserved are then re-copied into new books.  In some cases wills may be re-recorded when fire or flood cause their loss, and a reliable copy of the will can be determined, in other court papers, perhaps a lawyer's copy in his file, or a copy left at home, etc.

VA - CRAZY CRATE 82 BOOK 1:  FAIRFAX COUNTY, VIRGINIA 1749 COURT ORDER BOOK.  By Charles & Virginia Hamrick, New Papyrus Publishing Company. 50 pages plus computer generated index in very small print on an additional 11 pages, heavy cardstock covers, glued wrapped binding.  The order book serves as an index to the actual court records from which these "shorthand" excerpts have been abstracted.  You want the actual case files copied for you.  Many of these entries contain information relating to deeds and wills, appointments of people to various jobs, such as collecting lists of tithables, inventory and appraisements of estates [Follow up on these! You may find a list of all the items owned, the appraisal and, perhaps an estate sale with a list of purchasers, who would be mostly friends, neighbors and RELATIVES!], Deputy Clerk of the Court Reords and this is just page one with fourteen entries.  New items appear on page two; such as a complaint against a sheriff for refusing to take into his custody a run-away Negro. Sheriff, for his contempt, was fined 20 shillings, three men were ordered into court to Inventory and Appraise an estate of a recently deceased man.   On page three several men took the Oath and were Certified to be Inspectors at varying Warehouses, a Grand Jury was called to inspect the evidence concerning all Crimes and Misdemeanours(sic) whatsoever committed, perpetrated or done within the County, a girl having a base born child.  [She was not alone.  Three others were individually named for the same offense,] one man was called for not keeping the Road in Repair, and one was called for a common Swearer by members of the jury and two Gentlemen were each separately charged to survey a road from point [his house] to (Point B-someone else's house) and ordered to keep the Road in Repair according to law.  On page four, a gentleman being summoned by a Sheriff to Serve as a Grandjuryman, refused to attend, and was fined two hundred pounds of Tobacco, but another man set forth his Age and Infirmities, praying to be discharged from paying his Levys.  Ordered that the said petitioner be exempted from paying any County or Public Levy for himself for the future. In another case, a man was required to pay four other men for witnessing against him in a case where he was found guilty of being a person of ill fame and behavior.  He had to stay in jail until he could enter into Bond with good and sufficient for Security, himself, for forty pounds Sterling and his securitys each in twenty pounds Sterling for his good behavior!  This book is full of the everyday occasions which pit one individual against another (or the County).  Fifty pages of Action of trespass, admission of debt, cases of bonding of orphan children, garnishments, petitions, recording of the little things which occur in life, but have tremendous consequences.  Everyone of them with names, sometimes locations, always with dates, but all proof that they were there in that county doing business on that day.  This is fascinating reading of the foibles of our ancestors and their contemporaries in 1749. 

[Pat's Tip:  If I find something unsavory about an ancestor, I think to myself, "Well, if he didn't want me to know about it, he shouldn't have done it!"  I will take a copy of it for my files, but that does not mean I will necessarily reprint it when I write about him.]
